By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Site is the property of Tuscany Flavor LLC and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Age Restrictions

The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Act in any way that could be considered fraudulent; or

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

When you create an account on our Site, you agree to the following:

  2. All personal information you provide to us through your account is up-to-date, accurate, and truthful, and you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Services

These Terms and Conditions govern the sale of services available on our Site.

The following services are available on our Site:

  • Hotel, Tours, Experiences, and Transfer Services
  • Digital booklets, guides, and maps

The services will be paid for in full when the services are booked online or as specified on the individual service-specific invoice.

These Terms and Conditions apply to all the services displayed on our Site when you access it or upon booking services. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that you are responsible for monitoring your payment instrument to verify receipt of any refund.

Third-Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

User Goods and Services

Our Site may allow users to sell goods and services. We do not assume any responsibility for the goods and services users sell on our Site. We cannot guarantee the quality or accuracy of any goods and services sold by users on our Site. However, if we are made aware that a user is violating these Terms and Conditions, we reserve the right to suspend or prohibit the user from selling goods and services on our Site.

Payments

We accept the following payment methods on our Site:

  • Credit Card;
  • Debit Card

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Refunds for Services

We provide refunds for services sold on our Site as follows:

Cancellation/Refund Policy

Cancellation Policy:

• Cancellations 31 days or more from date of first service have a €25 fee per service plus the cost of tickets and/or entry fees.
• Cancellations 30 to 8 days prior to the first service date will receive a refund of 50% minus the cost of any tickets and/or entry fees.
• Cancellations within 7 days of service and no shows are non-refundable.

Prepaid entry fees and tickets are non-refundable under any circumstances.

Late Change Fee:
A 20% fee will be charged for late changes to itineraries, dates or times of services for changes submitted
within 7 days of travel, in addition to any vendor’s cancellation fees.

Digital booklets, guides, and maps – Are non-refundable for any reason.

Dietary Accommodations

 Each gastronomic tour has a list of possible dietary accommodations specific to the said tour.  Dietary requests or restrictions are to be made at the time of booking.  Dietary requests made upon arrival for the tour cannot be guaranteed.  Any cancellations or rescheduling fees associated with dietary requests or restrictions follow our cancellation policy.    

***IMPORTANT***
Our tastings are prepared and/or stored with products that may contain allergens so the possibility of cross-contamination cannot be eliminated. This includes tastings on tours adapted for dietary requests and/or restrictions.

Travelers who participate in our tours with allergies or immune disorders do so at their own risk. 

Please note that tastings and stops may vary slightly from the tour description depending on the season, date and time of booking, group size, or unforeseen closures.

Travel Documentation

Travelers are responsible for ensuring that he/she/they meet foreign entry requirements and that his/her/their travel documents, such as passports and visas, are valid and compliant.  We urge customers to review travel prohibitions, warnings, announcements, and advisories issues by the relevant governments prior to booking travel to international destinations.

Travel Insurance

Tuscany Flavor LLC does not offer nor include personal insurance for travelers and or services.  Tuscany Flavor LLC does not offer refunds outside of the cancellation policy for any circumstances including sickness, accidental injury, or death of you or a family member (or of a traveling companion), weather delays, natural disasters, unexpected changes in your employment, and many more specified reasons. Trip insurance, while not required, is highly recommended. Tuscany flavor can not be held responsible for any injuries, sickness, travel delays, change in circumstances, or loss of opportunity before, during, or after your services. Guests opting not to purchase travel insurance should be aware that no refund of your reservation will be available outside of the cancellation policy; therefore, your entire booking payment is at risk.

Force Majeure

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes (which causes are hereinafter referred to as “Force Majeure”), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic (including the Covid-19 pandemic), quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or generalized lack of availability of raw materials or energy.

For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder.

The Parties hereby acknowledge that while current events related to the Covid-19 pandemic are known, future impacts of the outbreak are unforeseeable and shall be considered a Force Majeure event to the extent that they prevent the performance of a Party’s obligations under this Agreement.

Airline Flights

Please note that we cannot be held responsible for the services and policies of the airlines involved in your travel arrangements. Flight schedules are subject to change without prior notice, and we cannot be held responsible for any penalties incurred for tickets and booking fees that are not  due to such changes. 

Hotel Bookings

Please note that our hotel profiles are based on information provided by our hotel partners and their representatives, including images and property descriptions. While we strive to keep the information up-to-date, we cannot be held responsible for any inaccuracies, changes in details or amenities, or images provided by third parties.

Consumer Protection Law

Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability

Tuscany Flavor LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.  Tuscany Flavor LLC acts as an intermediary only and any services booked are a direct agreement between the clients and individual vendors.

Assumption of Risk

If you choose to use Tuscany Flavor LLC’s services, you acknowledge that the travel you undertake may involve dangerous activities and carry a risk of injury, illness or death caused by natural forces, animals, insects, plants, the negligence of Tuscany Flavor LLC, or other persons and companies known or unknown, or the willful or criminal actions of third parties. You also understand that weather conditions may be severe and medical services or facilities may not be readily available. To fully enjoy your adventure, you agree to accept these risks as an integral part of the experience and assume full responsibility for any resulting illness, injury, or death. You also release Tuscany Flavor LLC from any claims related to third-party negligence. You confirm that you are physically able to participate in the activity and have no medical, physical or mental conditions that would put you at risk.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Tuscany Flavor LLC and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of North Carolina.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and Tuscany Flavor LLC are unable to resolve any dispute through informal discussion, then you and Tuscany Flavor LLC agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Tuscany Flavor LLC.

Notwithstanding any other provision in these Terms and Conditions, you and Tuscany Flavor LLC agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. Users are responsible for reviewing terms and conditions and any updates or amendments will be documented via the effective date listed below.

Media Release

By participating in our services, you grant Tuscany Flavor LLC the irrevocable and unrestricted right to use and publish any photographs or videos taken during our tours, excursions, transfers, or trips for marketing, promotional, and advertising purposes. This may include but is not limited to our website, social media channels, brochures, and other promotional materials without payment of any compensation to the traveler.
